General conditions of Sale
1. Introduction
1.1.These General Terms and Conditions of Sale ("CGV") govern the distance purchase, by the user ("Customer"), of the products promoted on the site www.ilturbante.it ("Website"), owned by the soc. Fair Fashion S.r.l. ("Company"), with registered office at Via Stalingrado 71 / 5b - 40128 - Bologna.
1.2 The Customer declares and guarantees that the purchase of the products is intended for a strictly personal use and not related to any professional or commercial activity performed.
1.3 The present GCS (present on the site and accessible to anyone) must be carefully examined by the Customer before completing the procedure for purchasing the products and / or services through the Website.
1.4 The sending by the Customer of a Purchase Order ("Order") for a product on the Site implies full and unconditional acceptance of the present GCS. The present GCS must be considered an integral and substantial part of the purchase contract.
1.5 Fair Fashion Srl reserves the right to modify these GTC at any time. In any case, the GTCs applicable to an Order are always those accepted by the Customer at the time the Order is sent.
1.6 Fair Fashion Srl can change at any time the assortment of products offered for sale and the information relating to them, without prior notice.
1.7 Fair Fashion Srl aims to provide constantly updated information on the Website. However, it is not possible to guarantee that the Site is completely free of errors. The Site may contain typographical errors, errors, inaccuracies or omissions, some of which may refer to the price and availability of the Product, and to the product information sheet. Fair Fashion Srl reserves the right to correct errors, inaccuracies or omissions even after an Order has been sent and also reserves the right to change or update information at any time without prior notice.

3. Subject of the contract
3.1 With this contract, respectively, Fair Fashion Srl sells and the Customer acquires remotely, through electronic means, the tangible movable property indicated on the "ilturbante.it" website in the specific section dedicated to online sales.
3.2 The products available for online marketing are described in the relevant information sheets. The image accompanying a product may not be fully representative of its features, but differ in color, size and accessory products.
3.3 These GCS do not regulate the supply of services or the sale of products made by third parties that use direct links to the Site through banners or other hypertext links / links. Fair Fashion Srl will in no case be held responsible for the provision of services promised by third parties or for the execution of electronic commerce transactions between Fair Fashion Srl and third-party customers.
3.4 Fair Fashion Srl reserves the right not to process orders received from users who are not "Customers", as well as any other Order that does not adhere to Fair Fashion Srl's commercial policy.
3.5 The products comply with the legislation applicable in Italy in force at the time of the Order.
3.6 The offers presented are valid for as long as they are published on the Site and within the limits of available stocks.
3.7 For products not immediately available in Fair Fashion Srl warehouses, offers published on the Site will be valid subject to availability. The indications on the availability of the products will be provided to the Customer at the time of sending an e-mail confirming receipt of the Order.
In any case, and in the event that, after sending the Order, the product becomes totally or partially unavailable, the Buyer will be immediately informed by e-mail of the unavailability of the product and of the total cancellation or part of the Order.
3.8 The sales prices displayed on the Website are understood to include I.V.A. and refer only to products sold online. The price applied will be the one in force at the time of the Order and indicated in the order confirmation e-mail, without considering price increases or decreases, even for promotions, which may have occurred later.
3.9 Transport costs, except where specified, are not included in the purchase price indicated, but are calculated at the end of the purchase process before the payment is made. Transport costs will be calculated based on the weight and quantity of the products and on the basis of the Order's destination. The total amount of the expenses will be visible before proceeding with the confirmation of the purchase. However Fair Fashion Srl, during certain periods or throughout the year, reserves the right to remove transport costs (in these free cases) when a certain amount is reached, linked to the purchase of one or the sum of more products part of the same order.
4. Conclusion and conclusion of the contract
4.1 The Customer declares to have full capacity to act and enter into a contract for the purchase of products on the Site based on these GCS.
Fair Fashion Srl cannot under any circumstances be required to verify the ability of visitors and Customers of the Site to act. In the event that a person who does not have the necessary capacity to act (for example a child) makes an Order on the Site, without prejudice to the responsibility of their parents or legal guardians for this Order and the related payment, Fair Fashion Srl may refuse to accept the Order.
4.2 Each Order sent by the Customer implies acceptance of the GCS, and constitutes an offer to purchase the products on the "Ilturbante.it" website.
4.3 Orders are subject to acceptance by Fair Fashion Srl which reserves the right, in its sole discretion, to refuse the Order, even in cases where:
(i) orders cannot be executed due to an error in the information provided by the Customer at the time the Order is forwarded (incorrect billing address; insufficient or incorrect shipping address) or in case of misleading information provided by the Customer;
(ii) an error has occurred on the Site relating to the products ordered, for example an error relating to the price or the description of the products as shown on the Site;
(iii) the ordered products are no longer available on the Site.
4.4 Fair Fashion Srl also reserves the right to suspend or cancel the fulfillment of an Order and / or delivery, regardless of the nature and progress of the evasion, in case of non-payment or partial payment of any sum due by the Customer , in the event of problems with payment, or in the event of fraud or attempted fraud concerning the use of the Site, also with reference to previous Orders.
4.5 In case of refusal of the Order, Fair Fashion Srl will notify the Customer, within 30 working days from the forwarding of the Order, of the impossibility to accept the Order. The customer can check the details of his order and correct any errors before the order is confirmed / sent.
4.6 With the confirmation of the Order, the Customer declares to have knowingly accepted the content and conditions of the Order in question and, in particular, these GCS, the prices, volumes, characteristics, quantities and delivery times of the products offered for sale and ordered by the Customer.
4.7 The sale will be concluded only upon acceptance of the Order by Fair Fashion Srl by sending an e-mail confirming receipt of the Order to the Customer.
A second e-mail will be sent to the Customer when his Order is shipped; upon shipment of the Order Fair Fashion will debit the amount of the Order.
4.8 Fair Fashion Srl recommends that the Customer keep the e-mails received on paper or in electronic form. The Customer is informed that the aforementioned e-mails will be sent to the e-mail address indicated when the Account was created and / or when the Order was prepared.
Fair Fashion Srl will not be responsible in case of insertion of an invalid e-mail address and / or failure to receive the order confirmation e-mail for reasons not directly attributable to Fair Fashion Srl. In this case the sale will be considered as definitive. The Customer may, however, exercise the right of withdrawal in accordance with the provisions of Article 8 of these GTC
5. Payment
5.1 The Customer guarantees Fair Fashion Srl that he has the necessary authorizations to use the payment method chosen for his Order at the time the Order is sent.
5.2 If the customer has a PayPal account, he can choose this payment method. In this case, the Customer will be automatically redirected to the website of the soc. PayPal to proceed with the payment.
Where provided, the Customer can pay by credit card through the PayPal site, using the cards accepted by the site itself.
5.3 The Customer can, as an alternative to the previous point, pay the order transmitted by bank transfer, whose coordinates are indicated on the Site and confirmed in the Order confirmation e-mail.
The Customer is required to send Fair Fashion Srl a copy of the transfer order at the addresses indicated in the order confirmation email. This documentation is an integral and essential part of the Order.
5.4 Fair Fashion Srl will not accept other methods of payment than those indicated in points 5.2 and 5.3.
5.5 All Orders are payable in Euro. Any bank charges will be the sole responsibility of the Customer (even in the case of a refund) and will not be calculated at the time of the Order.
In case of non-payment or late payment of the Order by the Customer, Fair Fashion Srl reserves the right to apply the default interest equal to the legal rate of interest starting from the tenth working day following the date of the Order or notification rejection of bank payment.
5.6 Fair Fashion Srl reserves, in any case, the right to suspend or cancel, at its own discretion and at any time, the execution of an Order and / or the shipment of the ordered products in case of non-payment or partial payment of each sum paid by the Customer, in the event of late payment or in the event of fraud or attempted fraud by using the Site, also in relation to previous Orders.
5.7 As part of the fight against Internet fraud, information regarding the Client's Order may be transmitted to third parties authorized by law or designated by Fair Fashion Srl for the sole purpose of verifying the identity of the Customer, the validity of the Order , the payment method used and the place of delivery.
5.8 No financial transaction will take place directly on the Website, but only through the telematic platforms of PayPal or the credit institutions involved in the transaction.
Fair Fashion Srl therefore declines all responsibility for any occurrence during the payment phases.
No data relating to the credit card used or to the user's bank details will be requested during the payment procedure on the Ilturbante.it Website
5.9 The issuance of the invoice is not obligatory, if it is not requested by the Customer no later than the moment of the transaction, as indicated in the art. 22 of the D.P.R. of 10/26/1972 n. 633.
By sending the Order to Fair Fashion Srl, the Customer agrees to receive the invoice / receipt in electronic format. After the invoice has been issued, it will not be possible to make any changes to the data indicated therein.
The purchase invoices are sent by e-mail to the e-mail address indicated by the Customer at the time of purchase (or registration) on the Site.
 
6. Delivery of products
6.1 The products ordered by the Customer based on these GCS will be delivered to the address indicated by the Customer as the delivery address on the Order.
6.2 Fair Fashion Srl sends, through the designated carrier, to all Italian cities and the European Union
6.3 Orders will be processed upon receipt. Fair Fashion Srl undertakes to deliver the products as quickly as possible, usually within 24-48 hours of receiving the order. If the product is not available at the time of the order an email will be sent to the customer informing him on the delivery date.
6.4 The goods shipped will be checked and delivered to the carrier intact and without defects. Fair Fashion Srl cannot be held responsible in any way for any delays or damage attributable to the carrier's faults.
6.5 The products purchased will be delivered to the address indicated by the Customer at the time of the Order.
 
7. Responsibility
7.1 Fair Fashion does not assume any responsibility for disruptions caused by force majeure or unforeseeable circumstances, even if dependent on malfunctions and disruptions of the Internet network, if it is unable to execute the Order within the time stipulated in the contract.
7.2 Fair Fashion will also not be liable for damages, losses and costs incurred by the Customer as a result of the failure to execute the contract for reasons not attributable to the same, and unless they depend on the fact or omission of Fair Fashion, the Customer having only the right to full refund of the price paid and any additional charges incurred, where duly documented.
7.3 Fair Fashion cannot be held responsible for information, data and any technical or other inaccuracies that may be contained on the site, if they have been communicated by third parties and have been verified by Fair Fashion according to the criteria of ordinary diligence .

8. Intellectual property
8.1 The Fair Fashion Srl trademark, of "ilturbante.it", all figurative and non-figurative marks present on the Site, images, illustrations and logos and any content on the Site (including, without limitation, these GCS) are exclusively owned by Fair Fashion Srl and / or the respective owners of the intellectual property rights thereon, without the Customer having any rights to the same from access to the Site and / or the stipulation of the purchase contracts.
8.2 Reproduction in whole or in part, modification or use of such trademarks, illustrations, images and logos, or any other content on the Site, for any reason and by any means, without the express written permission of Fair Fashion Srl and / or the respective owners of the intellectual property rights on the same is strictly prohibited.
 
9. Applicable law and competent jurisdiction
9.1 These GCS and all sales of products on the Site are governed by Italian law, regardless of the place of shipment of the Order.
9.2 Any dispute concerning the existence, interpretation, execution or termination of these GCS and / or the contract concluded between the customer and Fair Fashion, will be assigned, in the absence of a transaction, to the exclusive jurisdiction of the competent Italian courts based on the place of residence. or domicile of the Customer, if located in the Italian territory.
 
10. Validity and duration of the general contract conditions
10.1 The present GCS, as amended from time to time, will apply for as long as the products will be offered for sale on the Site and until the terms of the legal and contractual guarantees expire.

11 Promotions

Fair Fashion reserves the right to carry out particular sales conditions or promotions on the Products present on its website. The conditions applied to the promotions will be regulated from time to time by Fair Fashion through specific communications to its Customers.
Unless otherwise specified, these General Conditions will be deemed applicable.

12 Registration

To purchase products, registration is not necessary.

However, registration and registration on the mailing list allows you to take advantage of any discounts or promotions if Fair Fashion Srl decides to make them.

Registration is free, fast and does not imply any purchase obligation.

The procedure for registering with the Site requires the completion of an electronic form, the fields of which must be filled in with the Customer's personal data and his email address. These data will be processed in accordance with current privacy protection laws. Following registration, the Customer will be the holder of a personal account which can be accessed through a strictly confidential user name and password. The assignment of these credentials guarantees the Customer an anonymous identification. It will be the Customer's responsibility not to disclose his password to third parties for any reason.

The Customer will be held responsible for any actions and irregular behavior and in contrast with the regulations in force or with these General Conditions committed by anyone who uses his personal account instead. The Customer is required to promptly notify Fair Fashion of any theft, loss or loss of the password, as well as any misuse by third parties of the account or his keyword of which he has become aware.
